"Ms. Austen, how do you plead?"
Written by Greggory Nations & Elizabeth Sarnoff.
Directed by Steven Williams.

"I have a child. I'm not going anywhere."
Kate Austen

At the Barracks, Locke interrogates Ben, but gets no useful information from him. Kate secretly visits Miles, and arranges a meeting between him and Ben. Miles tries to get Ben to bribe him to leave the Island and pretend he's dead, but they are interrupted by Locke. Miles confirms that he knows who Kate is, and that she cannot escape from the law when the survivors are rescued. Locke tells Kate she is no longer welcome with him. After an argument with Sawyer, Kate leaves the Barracks to return to Jack's group. Locke steps up his interrogation of Miles.

At the beach, Jack struggles to get in contact with Sayid and Desmond on the freighter. Daniel practises some simple memory exercises with Charlotte, and she tells him he is making progress. Charlotte calls Regina, who tells her that Sayid and Desmond haven't arrived yet, even though they left a full day ago.

In flashforwards, Kate is on trial for murdering her father, among other crimes. Kate's lawyer tells her that her case is hopeless unless they use her son to gain sympathy, but she refuses. Jack is called as a character witness for Kate. Kate's mother, the prosecution's star witness, asks Kate to let her see her grandson, but Kate refuses. Diane retracts her testimony, allowing Kate to cut a deal without jail time. Jack tells Kate that he still loves her, but she says that they will not have a relationship until he is ok spending time with her son. It is revealed that Kate's son is really Aaron.

Tropes in this episode include:

  • Batman Gambit: Kate asks Sawyer to help her bust Ben out of his prison in Locke's basement to talk to Miles, knowing Sawyer will tell Locke and the two will go to the boathouse to find out what Miles wants, giving Kate the opportunity to bust Miles out and go visit Ben with him while they are distracted. It's later revealed that Sawyer was in on the plan the whole time, but pretended to have been fooled too to help trick Locke.
  • Character Development: Kate, who has been characterized for three seasons by her inability not to run away from her problems, accepts a plea deal in which she cannot leave the state, saying that she is not running anymore now that she has a child.
  • Heel–Face Revolving Door: Kate switches sides for the second time in as many episodes, leaving Sawyer and heading back to the beach to return to Jack's team.
  • Innocently Insensitive: Kate does not take kindly to Sawyer's very enthusiastic celebration of the fact that she is not pregnant.
  • Irony: Jack makes the customary oath to "tell the truth, the whole truth, and nothing but the truth." But his description of their time on the island is nothing but lies.
  • Jerkass Has a Point: Sawyer may be a bit of a jerk in how he phrases himself, but he's not exactly wrong to point out that Kate has been doing a lot of flip-flopping between himself and Jack.
  • Loose Lips: Kate easily tricks Hurley into giving up Miles's location, and Sawyer states that he's told pretty much everyone else at the Barracks this too.
  • No Periods, Period: While not outright stated, Kate is suddenly very sure that she isn't pregnant after several episodes of worrying that she might be. It's also stated that despite spending the night together she and Sawyer didn't have sex.
  • Only in It for the Money: Although Miles has been hired to find and capture Ben, he offers to tell his employer that he's already dead for $3.2 million.
  • Red Herring: Much of the episode implies that Kate is or will be pregnant on the Island, and sets up a potential mystery around whether Jack or Sawyer is the father of her son in the future. The final flashforward reveals that the answer is neither, as her "son" is actually Aaron.
  • The Reveal: Kate is raising Aaron in the future and Claire is nowhere to be found.
  • Wham Line: The final line of the episode, revealing the true identity of Kate's son.
    Kate: Hi, Aaron.
  • Wild Card:
    • Despite having supposedly joined Team Locke, Kate makes very clear that she is ultimately serving her own agenda, as she arranges a meeting between Miles and Ben against Locke's wishes to get information from Miles and then switches back to Team Jack by the end of the episode.
    • Miles also proves to be this for the freighter crew. Although he was hired to find and capture Ben, he tells Ben that he's Only in It for the Money, and will tell his employer that Ben is already dead in exchange for a big enough bribe, even offering to "take care of" Charlotte, since she's already seen Ben alive.
