I think the implications that Saishuu students are criminal have died out already, with Famitsu's explanation of how this SHSL system works.

The "Gifted program" was established by the government and all SHSL students were granted money and special rights, but they are all spread throughout the country without attending the same school. Until suddenly all of them were gathered in Saishuu for unexplained reasons, that is. We also have a screenshot telling Saihara, in an very impressed tone, that this is the first time she's ever meeting another SHSL.

Kodaka has made it very clear that DRV3 is a separate story from the Hope's Peak Saga. Saishuu Academy has nothing to do with Hope's Peak Academy.
The students are definitely criminals. Why else would the words 'for Gifted Inmates' be in the school's name?

囚 sure is associated with prisoners, but the main meaning of word is just "captured". Saishuu could very well also be translated "Talents captured". If the "school" was there for the sole purpose of gathering the SHSL and locking them there, then that still fits the name's meaning without they needing to be criminals.

So this is purely a speculation question but still I gotta ask just for fun: How bad do you all think V3 is gonna get?
I mean its obviously bad, D3 ended pretty good actually for nearly everyone involved & despite that, here we have another Mutual Killing Game where a bunch of talented young children are being force to murder each other by some psychopath who was able to have pulled good old Monokuma out of storage. There's even more Monobears who may or many not be piloted by separate individuals or equally deranged A.I.s. The students this time are also apparently criminals implying some good amount of worry over who the fuck these kids really are. So honestly things must have gotten pretty fucking bad after all.
Personally I believe depending on the time V3 takes after that all these kids are from Makoto's new school & something or someone happened that totally fucked him & the rest of the old-guard that enabled them to imprison the current cast for whatever horrid reason.
