The protesters were there legally, but their right to protest was revoked before being gassed.
This is not news. This has been the story for a year.
What's changed is a DOI guy appointed by Trump is saying that "it's totally a coincidence, guys." Believing "We wanted to put up fences, and just happened to crackdown on peaceful protests on a late evening well after anyone would put up fences note and that just happened to coincide with Trump doing a photo op" is... honestly adorable. Keep that naivete.
"The DOI wanted the area clear" and "the White House needed the area clear now" aren't mutually exclusive statements.
Frankly given the timeframe it would be more damning to the administration if they didn't gas the protesters because that's such an incompetent move to schedule something and not have the ability to actually do it safely.
A Trump crony saying "oh yah Trump was 200% right" isn't exactly a compelling argument.
