- If Herbert has done so many criminal acts, why hasn't he been put on trial or at the most arrested for a lengthy prison sentence? Club Penguin has been shown to have other forms of law enforcement besides the Elite Penguin Force.
- Because they can't catch him to imprison or trial him. Almost every mission and PSA/EPF Operation ended in Herbert escaping.
- In the PSA mission "Secret of the Fur", when Gary's machine successfully analyzes the white fur, it shows a picture of a normal polar bear, rather than an anthropomorphic one like Herbert. Does this mean non-anthropomorphic polar bears exist? Do non-anthropomorphic penguins exist?
