GW seems to be in general archaic company that hates their fans if their bad PR is any suggestion tongue

[up][up][up]Well tough shit to GW; last time I looked parodies were legal. On top of that, a moderate percentage of characters were unique to the series as well, which just adds to the argument for fair use.

I think the issue here is that Alfabusa's technically earning some money from it. Patreon and the like. Total bollocks to cancel him over that, but hey, companies.

[up]Nope, the new infringements policy bans all fan films and animations regardless of monetization status.

Fan-films and animations – individuals must not create fan films or animations based on our settings and characters. These are only to be created under licence from Games Workshop.

Nothing there about monetization.

I recall watching a video on fair use (by Tom Scott I believe?) that gave the impression that fair use is more narrow than people think it is. From what I gather, the key thing is essentially if your work can act as a reasonable substitute for the official product. For example, when Weird Al makes song parodies, he contacts the creators first and gets permission.

This does suck though. With 40K I was kind of a Fanwork Only Fan. Canon is a bit too dark for my tastes, I liked the sillier take TTS provided. So I'm probably not gonna stay away from 40K for the time being.

The question of whether or not it's technically legal is basically irrelevant, as Bruva pointed out: he doesn't have the time, energy or resources to fight a giant corporation.

Yep, corporations don't need to be right, they just need to have more staying power than the other side.

Which they usually have.

With music, as long as you declare something a cover (if you're singing it yourself), it's fine. Though using licensed music without permission is still a nono.

As Alfabusa points out and said [up][up][up][up], while he might very well be legally in the right, that wont matter if GW decides to press the issue, because he'd need to fight them in court, and having a newborn kid, this isn't something he can casually afford or risk, while for GW, a corporation, it's a pittance to drown him in legal battles. And GW is notoriously litigious (Remember when they tried to sue an author for using the word "Space Marine") when they know they are facing someone who doesn't have the resources they do.

Plus none of that changes that the very attitude of GW burns him.

Doublepost to add:

In good news, Alfabusa's patreon has almost doubled since yesterday so his worries about his new projects getting screwed over by youtube are at least less so now.

Updaaa AAAAAAAAAAAAAAAAAAA

mY FUCKING GOD W H Y IS THE PATREON AT OVER 10,000 DOLΓ–LAR WHY HAVE YOU DONE THIS

I MEAN THANK YOU THANK YOU SO MUCH like seriously I APPRECIATE IT SO MUCH HOLY SHIT but I hope you know that whatever I post next might just be an utter flop! A complete disaster! An absolute trainwreck!!

We’re heading into unknown territories, we won’t really know what we are doing. We will try our hardest OF COURSE but I just want to make absolute certain to everyone, new and old, that this will be a very experimental stage for us as creators and whatever we make next might just, if we are especially mislead, make you entirely regret your pledge. Hopefully that will never happen, but, I need to be a bit pessimistic here as something of a… survival mechanism???

No matter what though I want you to know that you are DEARLY APPRECIATED and both the team and my family would like to thank you personally, bigly and genuinely for your support.

AND ALSO thank you to everyone who has left exceptionally nice and supportive posts here and beyond, and I am sorry if I cannot respond to all of them BUT KNOW that I HAVE read them and felt them. You are so, so nice.

I’ll make a more thorough update in the future but, for now , I need to rest my sludgen brain for it has been WAY overstimulated, I am unsure if humans were built for this kind of attention.

Thank you. Thank you, thank you. Have a good one.

Pretty sure GW is doing that because they want to launch their own streaming site (like virtually everyone and their mother these days) and they see animated fanworks as competition.

It's rarely actually about copyright, it's about maximising profits (or at least how companies like GW think maximising profits works).

Bruva was merciful enough to leave a pinned comment on the second video where he provides spoilers for what the third part (yes, this was supposed to be a three-parter) would have been like. For one, the survivors of Shield-Host Proteus get their hands on the Proteus Protocol and use it to resurrect Kitten, though predictably he came back wrong (implied to be temporary).

BTW... WTH was that creature that was next to Malys and quietly scurried off after she explained her plan? Feels like it's a Chekhov's Gunman.

On a different note, if anyone cares, for a long while I have been writing notes for my own WH40K fanfic that's essentially a reimagining of TTS (no criticism towards Alfabusa's work, I just want to indulge in my own take of the basic premise). Example: That Necron girl from StringStorm's WH40K Idols series (who is actually a pre-existing OC originally named "Lolicron", whose first rendition was drawn by Jo Pereira of Nerf NOW!!)? She's a character, and is the Daddy's Girl of an eccentric Necron Phaeron that made sure his daughter got the best Necrodermis body possible (thus why she's the only one that retains her pre-Great Sleep outer shell and so doesn't look horrifically skeletal), as well as ensured that the non-noble subjects of his dynasty had enough semblance of sentience in them to appreciate his daughter's godlike singing.

The indefinite hiatus of TTS has fanned the flames of my muse for this fanfic just a tad, which is saying something when considering all the priorities that are competing for my attention. If anyone has ideas, feel free to suggest them.
