The later is still the one who preformed the spell after being warned not to. So yeah his is his fault in my opinion.

Fan-Preferred Couple cleanup threadI don't really find the spell being risky as that much of a problem. A lotta spells have some kind of risk factor to it and in this case it is a necessary spell to help Peter.
He has to figure out some way to get everyone to forget Peter's identity.

It's clearly not the intention of those scenes, but it's not impossible to believe them dissipating was then dying in both cases.
Haven't watched Amazing 2, but with Sandman? Don't see how.
He was clearly seen flying away, not just dissipating.

Two possibilities: these are alternative versions of the "original" Maguire and Garfield baddies who in their respective timelines, did conclusively die in their respective timelines - Maguire's Spiderman was deliberately trying to kill Sandman at one point, possibly this is a version that succeeded.
Alternatively, these are the "original" versions who didn't die in the movies, but did later on for some reason, if they fought again.
