Green and Fontana identify a murder victim, Billy Trammel, as a convict just released from prison - as it turns out, only a few hours before his death. Whilst incarcerated, Trammel was a member of a neo-Nazi gang called "The Brotherhood." A line of inquiry involving a fight between Trammel and an inmate from a rival gang leads to the discovery that Trammel had a violent clash with John Worley, a corrections officer at the prison. With the murder weapon connected to Worley, he is arrested.

Worley is terrified of The Brotherhood, which has been stalking and threatening his family. He believed he would be killed now that Trammel was out of jail, and his lawyer claims that killing Trammel was self-defence. The case now rests on whether a jury decides Worley's belief that he was in imminent danger is reasonable. Worley's lawyer refuses a plea, confident that the jury will be sympathetic.

Judge Amanda Anderlee, who is presiding over the trial, receives a death threat but chooses not to recuse herself. The defence produces evidence of numerous deaths and serious violence caused by The Brotherhood, and even calls their leader as a witness. Worley repeats his story that he believed Trammel would kill him and his family. But McCoy demonstrates that Worley may have been planning to kill Trammel at least two months before his release, and asks why Worley didn't just report Trammel's threats - which would have got him sent back to jail for violating his parole. The jury hangs and, almost immediately afterwards, Worley's wife "disappears."
