Should it be noted that this argument is explicitly and specifically illegal for prosecutors in the US to use? This has been clearly decided to be a violation of the the defendant's rights, as the prosecutor must prove they actually did it, not that the most likely case is they committed the crime.

I wouldn't add it without a citation.
Like any statistical fallacy, if this goes unchallenged in any court, anywhere, then something's probably gone horribly wrong.
