* IdiotPlot: Pretty much everything that happens after Aaron gets back from Josef's house is inexcusably stupid on his part, and the movie would've ended much sooner if he was even the least bit competent and didn't play Josef's games. It's so bad that ''Josef himself'' is confused that Aaron allowed his stalker to [[spoiler: kill him so easily.]]

* IdiotPlot: After the initial shock wears off, it becomes increasingly clear that the premise depends on this. [[spoiler:As in, it depends on Aaron -- and presumably countless other victims -- ignoring various red flags, not talking about their new client to anyone, being isolated and without a visible support system, and not pressing the matter to police. And most of all, showing few signs of self-preservation, such as going alone and with no warning to meet up with someone who's been stalking them. Or simply bailing on the house, hiding somewhere and finding a way to get law enforcement to act upon his complaints; although surely that would have been helped had he actually thought to retain the evidence Josef sent him rather than tossing it in the trash. Reviews and fans alike admit that Aaron is leagues dumber than the average naive horror film protagonist. The film itself uses a HandWave to suggest that Aaron was just a [[GoodIsDumb good and trusting person]].]]
** In the sequel, Dave may or may not be a victim due to this, too. Helping his case is the suggestion that Josef has inserted himself into his life in a different manner than he did with Aaron; he appears to be a concerned friend who struck up a friendship with Dave organically rather than necessarily inviting Dave to shoot a documentary and then stalking him including with the use of DVD recordings, as was the case with Aaron. It turns out, of course, that it ''wasn't'' organic and that he actually showed up right at the time Dave received the first DVD. Also, as a racial minority Dave may have had even more trouble getting the police to take his complaints seriously than Aaron (a white man), in all fairness. What doesn't help his case, though, is like Aaron, he does not appear to have made any attempt to split out of town and losing Josef's tail on him (assuming Josef is capable of doing that, e.g. with a camera or GPS tracker covertly installed in his car).
** To her credit (and also to that of the filmmakers), Sara has much less of the problems which affected Aaron in this sense. While she has doubts that Josef is telling the truth about being a serial killer (even after being shown video evidence), she never the less puts her guard up, arming herself with a knife in her boot (which Josef only manages to remove in the confusion when she rushes to make sure he doesn't hang himself). Also, almost all of the movie takes place in the house where she meets up with him, with no section afterwards depicting her just trying to lay low in her house like Aaron or Dave. The exception is that in the epilogue someone appears to have tracked her down in Manhattan, but this still seems much more comparatively safe for her (being of course a very crowded city) than merely hiding in her residence, and she seems to have changed her appearance and taken other steps to ensure her safety.

** Even though the main page describes the sequel's ending as a BolivianArmyEnding, Sara is not really under threat. Whether it's Josef himself or some imitator who's stalked her onto the subway, this is a crowded environment and his ability to either attack or just keep following her would be severely compromised. Even if you figure the [[BystanderSyndrome jaded commuters on the NYC subway wouldn't lend a finger to help her under any circumstances]], it's more than likely she has some kind of concealed defensive weapon as a precaution, and depending on what type it is she would use justified self defence to either kill him or subdue him (taser, anyone?) until the police could put him away for multiple life sentences (or, in the case of an imitator, some lesser charge, giving her the chance to move away again).

Indeed, if the stalker is none other than Josef, his motivation in revealing his presence to her with his trademark whistle (as opposed to hiding in plain sight and continuing to stalk her to a more secluded area) may just be a continuation of his DeathSeeker tendencies he said he had in the main body of the film. Maybe he still wants her to kill him, or for the police to gun him down.
