Jeffrey Spencer does never at any point actually claim to be a horribly mutilated Mulder, and he even repeatedly denies it when directly asked if he is, but he still remains vague enough in his wording, and counts on his DNA test to pass for a close enough match for Mulder (due to them being half-brothers), to manipulate Scully and the rest of the team into thinking that he ''could'' be, so that he can get close enough to William to carry out his plan.
