I don't know, and if they actually sell it to people, I think Sega could do a cease and desist.
Ian Flynn is probably having a Heroic BSoD over this. (Or maybe he's contractually obligated to not react to this kind of stuff. I don't know.) But yes, please let this give Sega an in to sue Penders.

So who created Scourge? I know that Penders created Evil Sonic, but he was basically Sonic with shades and a black jacket. But Ian Flynn was the one who named him Scourge and made him green.

A comic book group had announced they had licensed Scourge from Penders, and were making a brand new comic with a redesigned Scourge. They had also opened up a patreon for the comic as well. Along with news of a scene from one of the group's previous comics, the possible political direction of the main artist, the possibility that Penders had licensed Scourge to a different group before he took it away, and Penders being himself, the general reaction to the news was extremely negative. Not even a week passed before the group canceled the project. So far Penders had said he only licensed Scourge to the one group, but who really knows at this point.

IIRC, it originated from an interview that mistranslated a comment about Sonic 2's Mobius strip-style thingies in Emerald Hill as being "Mobius worlds".

The trailer for the fan-produced third season of Sonic Satam dropped yesterday, with a cover of the 'Fastest Thing Alive' by Crush 40. It looks pretty slick. Sega are reportedly in contact with them and apparently are waiting on a finished pilot to consider
