From a small amount of research I did it's it not (in the US at least) unless it's a resource that's considered necessary goods. Some people nearly got in trouble a while back this year for trying to do that with face masks.
Also when it is illegal it's called price gouging.

I think if you want to fight this legally, you'd have to show that this no longer falls under private resales, and is instead a commercial business.

A console's best games rarely come out within the first year anyway, it's always just a bunch of tech demos and basically last-gen games with a shiny coat of paint for the first year.
Certain people still claim the PS 4 doesn't have any games all these years later, so that hardly means much. But yeah, I wouldn't announce "Hey, we're going to fuck around for 2 years. Hope you don't regret buying this console." if I were the CEO.

Really, the reason I've stuck with Playstation all these years is because of the exclusives, but we're talking back when Final Fantasy games were only on Playstation. These days it's The Last Of Us, Bloodborne, Demon's Souls, Horizon, God of War, that kind of thing. There's only been a handful of Xbox games I feel I've missed out on... thinking about it, actually only one off the top of my head, maybe two.

Literally just Halo.
It's been 3000 years…I did enjoy what little time I spent playing Halo at a friend's house, but the game I'm thinking of in particular is DONTNOD's Tell Me Why, just because I love DONTNOD and I've played every game they've made so far except thatnote , because it's, actually, I don't even think it's Xbox exclusive, it's just not on Playstation. The 'maybe' one is the Hellblade sequel, not coming to Playstation because Microsoft bought the devs, but I'm just pretending that doesn't exist because I won't be able to play it, and I'm not sure the game needs a sequel anyway.
I got an email from my local webshop that the PS 5 was available for pre-order... which of course was sold out right away anyway. At least they try to limit it to one console per customer.
Also, the PS 5 appears to have been review bombed with one star reviews. Basically people are blaming the store for being out of stock and for grifters buying up all consoles, which is hardly fair, but of course people gripe anyway.

Apparently so. And Yahtzee was declaring this a humdrum generation last week.
Though I suspect scalpers make up a good portion of those sales.

Optimism is a duty.Smaller website antonline.com put PS 5’s on sale this morning, and bots caused the entire thing to crash in 20 seconds.
Over the weekend Game Stop tried to circumvent that with a “go to the store and order our limited amount for later” deal, but many people who reported sales apparently had their orders cancelled the following day.
Expect similar cat and mouse nonsense as the supply chain remains strained through Q2 2021.
Presumably they can justify the cost against the near-certain profit to be made, but yes, I wonder where they get the funds from too.
Scalping must be near impossible to police or regulate, if it's as much of a problem as this. Is it even actually illegal? I feel like I should know that, but I don't.
