While the judge clearly liked the defendant more than the prosecutor, none of his decisions were legally incorrect. Jack’s recusal motion was based on the fact that the judge denied his motion for a mistrial. Unfortunately for Jack, being caught off guard by a defense strategy is not grounds for a mistrial, and asking a judge to recuse himself because he’s the same ethnicity as the defendant is improper and offensive. Jack earned his chewing out. It’s meant to seem unjust because the story is told from Jack’s point of view, but the Strawman was absolutely right.


* ArtisticLicenseLaw: [=McCoy=] realizes that part of Dworkin's defense is to play to the sympathies of the mostly-Jewish jury and the Jewish judge in the court by claiming that his client was taking the money from their business to aid in the Israeli-Palestinian conflict. He quickly files a request to have the judge recuse himself from the case, but all he gets is a [[WhatTheHellHero chewing out from said judge]] for even playing that card. The problem is, under 28 U.S. Code § 455, judges ''must'' recuse themselves under Section A (if they can't be impartial, of which he isn't being) and Section B Part 1 (if they have a personal bias in the case, which he certainly does given that he shares a religious background with the accused). Nothing comes of it, nor is the judge sanctioned for his refusal to recuse.

To that end, he selects a majority-Jewish jury, has the trial overseen by a Jewish judge, then claims that Strelzik killed in self-defense because he was stealing money to help Jews overseas in Israel that are dying due to the Israeli-Palestinian conflict. It initially works in his favor, but [[SubvertedTrope [=McCoy=] beats him at his own game]] for one simple reason--he reminds the jury that, sympathetic motive or not, Strelzik still killed a man, and whatever's going on in Israel has nothing to do with existing US laws regarding murder.

The detectives investigate the murder of bookie Gordon Meeks. They soon establish that the killer is his partner, Stephen Strelzik; Meeks was going to report Strelzik for stealing from their business, so Strelzik killed him. Strelzik's attorney, Dworkin, deliberately selects a majority-Jewish jury then has Strelzik reveal on the stand that he was stealing to send funds to Israel. The judge, also Jewish, is very sympathetic to this and won't do anything to stop it. In [=McCoy=]'s summation, he asks the jury to consider the facts of the case and uphold the law, not let themselves be manipulated by an appeal to their personal loyalties. They convict, and Strelzik gets a life sentence for felony murder. Dworkin privately tells [=McCoy=] that although he had to defend his client, he personally doesn't think Strelzik should be out on the streets.
