Back in the 50's my grandmother worked as a teller in a Charlotte, NC bank when one of "those" showed up. Informed her that "this was a robbery" and quietly demanded some sum of cash. She pointed to the nearest armed security guard and told the would-be robber that he was the manager and since "he was the only one with keys to the safe" any further inquiries should be directed to him.

As if civil asset forfeiture wasn't bad enough, Oklahoma can now max out your credit cards, too. Cross-posting to US Politics.

The Oklahoma Highway Patrol is using a new device that enables them to seize money in your bank account.

Last month, the OHP started using 16 ERA Ds, or Electronic Recovery and Access to Data machine, reported News on 9.

The process of seizing money electronically works similar to civil asset forfeiture, where police can seize property or cash if they believe it is connected to a crime. They can do this without a warrant or arrest, and they don’t have to prove a crime was committed first.

If a trooper suspects you have money tied to a crime, the highway patrol can use the ERAD to scan any cards you have and seize the money.

“We’re gonna look for different factors in the way that you’re acting,” Oklahoma Highway Patrol Lt. John Vincent told News on 9. “We’re gonna look for if there’s a difference in your story. If there’s someway that we can prove that you’re falsifying information to us about your business.”

Once someone’s money is seized, it is up to them to prove that the money is not connected to the crime.

“If you can prove can prove that you have a legitimate reason to have that money, it will be given back to you,” Vincent said. “And we’ve done that in the past.”

However, State Sen. Kyle Loveless, R-Oklahoma City, told News on 9 that the ability to seize money like that removes due process and the belief that a suspect is presumed innocent until proven guilty.

He said he has already seen instances where police have abused the system, so he is planning on introducing legislation to change it.

Loveless said he will propose legislation that will require a conviction before any assets could be seized.

“If I had to err on the side of one side versus the other, I would err on the side of the Constitution,” Loveless said. “And I think that’s what we need to do.”

According to News on 9, OHP paid ERAD Group Inc. $5,000 for the software and scanners, and will give them then 7.7 percent of all the cash the highway patrol seizes.

I have to wonder just how much of a discount Oklahoma got from the ERAD Group ...

Dashcam footage of cop tasing, dragging, and dropping teen is unsealed

A federal judge on Monday unsealed disturbing dashcam footage of a suburban Kansas City, Missouri, police officer tasering a 17-year-old motorist who became brain damaged after what was billed as a routine traffic stop. That stop subsequently turned into an event of excessive force—resulting in a four-year prison sentence for Officer Timothy Runnels of the Independence Police Department.

The video shows Runnels tase and yank Bryce Masters out of the car and down on the street as Masters howls. The boy was filming the officer with his mobile phone, which the officer flings to the street. "Am I under arrest? Am I under arrest?" the teen is overheard saying before he is stunned and grabbed from the vehicle.

The officer drags the boy on the street like a sack of potatoes then drops him face first to the ground. During the brief 2014 incident, the boy, who was going to play Xbox with a friend, went into cardiac arrest and now suffers from brain damage. The traffic stop was based on a warrant from Kansas City, which turned out to be a mistake connected to the license plate on the vehicle the boy was driving. The officer claimed he also smelled marijuana and that the teen was being uncooperative.

The boy nearly died and was placed in a brief medically induced coma. The stun gun discharged and hit the boy near his heart for 20 seconds. He can be overheard weeping as the officer drags him following the Taser hit.

Local authorities did not prosecute Runnels. So the Justice Department, having dashcam and eyewitness evidence in hand, took the case to a federal grand jury which indicted the officer last year on two counts of excessive force and one count of falsifying the account. "Specifically, the defendant authorized and submitted a false and misleading official police report, which falsely described and omitted details concerning the force that he used against B.M. on September 14, 2014, and the circumstances that led to B.M.'s bodily injuries on that day, with intent to obstruct any investigation into the deprivations of constitutional rights described in Counts One and Two of this Indictment," according to the indictment (PDF). The officer agreed to plead guilty (PDF) to a single excessive force count in September and was sentenced June 1.

"This former police officer was trained and entrusted to enforce the law impartially," said US Attorney Tammy Dickinson. "His use of excessive force violated both the public’s trust and his oath to uphold the law. Police officers are not above the law and will be held accountable when they violate the civil rights of the citizens they are sworn to protect and serve."

Police originally said, "Officer Runnels instructed the driver to move to the curb. Officer Runnels stated that the driver did not comply with his command, at which time, he grabbed the driver from behind and carried him to the side of the roadway."

US District Judge Dean Whipple ordered (PDF) the release of the dashcam footage Monday after the officer's attorney decided not to challenge its release.

At a court hearing last month, the boy told the judge that "People tell me I'm different. I feel different." He said he is forgetful, withdrawn, and weak. Masters said he has nightmares and no longer plans to attend college.

"I get in the car to go somewhere and then I’ll forget where I was going," he said. "I’ve missed job interviews because I forgot them."

During that same May 26 sentencing hearing, the defendant said he was "deeply remorseful" and "at no point did I intend to hurt him, but I did."

The officer remains free on bond and must surrender to federal prison in August.

It sounds like the lad was being a bit belligerent with the traffic stop. That does not, however, justify anything that was done to him or the attempts at disguising the truth that followed. Being a bit belligerent is supposed to mean that you are mercilessly and without hesitation given a ticket. Not tased, dragged into the street, and beaten.

I'm glad to see that justice was done with the officer being convicted, because it certainly wasn't done at the traffic stop. Also glad to see that the officer, at least, is accepting responsibility now.

Crossposting from US politics thread: there was a mass shooting at a gay club in Orlando last night. Initial incident started at around 2:00 AM and suspect exchanged fire with the responding officers. Situation deteriorated into a hostage situation. There was some communication between the suspect and the authorities, but no details have been released. Around 5:00 AM, SWAT was sent in and the suspect was killed. Around 30 hostages were rescued, but the total death toll is being reported as at least 50 right now (up from 20 earlier this morning), with 53 people hospitalized. One of the SWAT officers was shot in the head by the suspect, but the round failed to penetrate his kevlar helmet. Holy shit. That is horrendous. I have a sinking feeling about the reasons behind the attack. As in this might have political and ideological ties to it.

Edit: And supposedly the shooter has claimed allegiance to ISIS. Fucking great.

Nope Trump won't be getting new supporters out of this, especially when he starts slamming Obama for trying to bring in gun controls that could have stopped this.

Clinton has seen a poll bump, not Trump.

As for the shooter, he at the last moment declared his loyalty to ISIS, but evidence from before seem to be that he was largly motivated by homophobia.

[up]I mean, the problem is that saying "He's a homophobe, not ISIS" is that if he's ISIS, he's almost certainly a homophobe as well. It's a core aspect of their ideology.

Going back to the Orlando thing, supposedly he also claimed ties to Hamas, Al-Quada, and the Taliban, which is not entirely unlike supporting both Nazi Germany and the Soviet Union during World War II.

The best theory I've seen is that he was pretty much just your garden-variety lone wolf spree shooter psycho, who decided to namedrop every terrorist group in the public eye in order to boost the media frenzy as much as possible.

I was going to make a joke about him mispronouncing Y'all Qaeda but this really isn't a joking matter. Regardless of his motives, 50 people are still dead.

But it's good to know that the Republican talking point of this being a foreign attack is provably bunk. He was just vomiting terror groups to enhance his media presence and the media latched onto the most relevant one. It fits with the growing narrative about the shooting being a manifestation of homophobic self-hatred.
