Yep, the governor has proposed a new bill to legalize gay marriage.

New York (CNN) — New York Gov. Andrew Cuomo proposed a bill Tuesday that would legalize same-sex marriage, effectively delivering on a promise he has made since taking office in January.

The Marriage Equality Act would grant same-sex couples equal rights to marry "as well as hundreds of rights, benefits and protections that are currently limited to married couples of the opposite sex," according to a news release from Cuomo's office.

In a statement accompanying the release, Cuomo said the state has "been on the right side of history," citing such civil rights battles as women's suffrage.

"But on the issue of marriage equality, our state has fallen behind," he said.

Cuomo has been a vocal proponent of allowing same-sex couples in New York to marry. In March, he released a statement saying that he was in the midst of a series of meetings to discuss such a marriage equality bill.

"Marriage equality is a matter of fairness and legal security for thousands of families in this state — not of religion or culture," Cuomo said Tuesday in announcing the proposed bill.

Although New York does not grant same-sex marriages, a 2008 appellate court ruling upheld the right of couples to have their same-sex marriages recognized if they are performed elsewhere.

The Marriage Equality Act would amend the state's Domestic Relations Law to say, among other changes, that "no application for a marriage license shall be denied on the ground that the parties are of the same or a different sex."

Democratic state Rep. Daniel O'Donnell said the bill has support in the state House.

"I've introduced it here in the House with 67 sponsors, which is an unprecedented number of sponsors for a bill," he said.

The state Senate rejected a bill to legalize same-sex marriage in 2009.

Five states — Massachusetts, Connecticut, Iowa, Vermont and New Hampshire — and the District of Columbia currently grant same-sex marriage licenses.

There are 31 senators out of 62 who definitely will vote for it, claims the New York Times, so we need only a few of them to decide in favour.

I heard that there are about 5 on the fence on the issue, most in the Republican camp.

That's what I heard, but I wasn't sure I remembered the figure correctly. Supposedly the republican higher-ups want it either to win big or not win, at all, to avoid the arguments about ATHEIST GAYS SHOVING BUMSEX DOWN OUR THROATS.

Five states? Of 50? Only 10% of America recognise gay marriage? Jeez louise! So if I got married to a man in Washington DC, I could get thrown in jail in California with my partner? Why don't you just get civil partnerships? Has no religious connotations whatsoever.

not thrown in Jail, It's just not recognized, so you get none of the benefits of your marriage in that state. Due to DOMA (Defense of Marriage Act) The Government doesn't recognize homosexual marriages either, so even if you're married legally, at that level you're still just two guys (or gals) cohabiting.

To be fair, Obama's ordered defense of DOMA to stop.

Boehner responded by using 1/2 million USD of tax-payer money to defend it himself. In the middle of the budget crap.

He's now got an ethics complaint against him for doing so. [lol]

God I hate the name of that bill. because it implies that somehow gays living together is like pointing a gatling at god fearing heterosexual marriages

Also, there are some states which recognize gay marriage and unions but just don't grant them, and some states which offer civil unions of some stripe. And then there's CA, which may or may not go back to having gay marriage again after the Prop 8 ruling.

Granted, the situation still sucks, but "only five states offer gay marriage" is a little bit misleading.

Hmm...anyone want to bet which state will be next? My wild guess would be on Maine, even though I know nothing politically about it. Why Maine? Who knows?

Maine had gay marriage for a while, in 2009, but there was a successful referendum to ban it again. Unfortunately. Although this reminds me of the time I was visiting a relative there, looked at her absentee ballot (with approval) and was amused to see a referendum on bear hunting. So a good and a bad memory.

You know, while I can deal with states choosing whether or not to grant marriages, it really does bother me that the question of whether or not to accept a marriage as valid also is allowed to change from state to state. Something as fundamental as who you're married to should not be allowed to change because you moved over a line in the dirt in the same country.
