Fire Emblem 4 partially does this. You get some legendary weapons, but the enemy has a lot too.
Fire Emblem does this all the time, even with an Infinity +1 Sword in Fire Emblem Tellius.
That being said, I'm pretty sure that isn't the only example.
Tales Of Vesperia, in which the final boss wields the legendary sword Dein Nomos. Although, he's not actually evil and he loans it to you for a few dungeons.
Legend Of Dragoon, IIRC. The enemy starts off with the Dragon Buster and you find out the hard way.
There was that boss from Star Trek Elite Force that had the Star Trek equivalent of a minigun. Does that count?

Pokemon generation four the is about the bad guy's quest to get the box legend and you stealing it from him to stop the end of the world.
Soul Calibur Legends starts off with the bad guys laying waste to the kingdom using the Holy sword. Oh, the good guys have the evil sword and have to get it back to full power. Guess how that one ends? Be glad its an alternate time line, wait never mind the main games just get rid of the Holy sword and give Soul Edge to evil right off the bat.

In Paper Mario Bowser has the Star Rod.
Modified Ura-nage, Torture RackA partial example in Final Fantasy VII; Sephiroth, of course, has the exceedingly long katana Masamune, although you're never given the opportunity to take it from him and you can't unequip it from him during his brief stint as a Guest-Star Party Member.
Another, straighter example is Gilgamesh from Final Fantasy XII; he holds in his possession a good number of ! the protagonists' swords from previous installments of the series, and also uses the devastatingly powerful Wyrmhero Blade during your second boss fight with him. That said, even if you beat Gilgamesh you can't actually obtain the Wyrmhero Blade until much later, once you've beaten the game's two strongest superbosses.

In Final Fantasy: Tactics, Marquis Elmdor has the Masamune and the second-best suit of armor in the game, and the only way to get that stuff is to steal it from him during the fight. It's not quite what you're looking for as it doesn't really have any story significance, and it's not the best equipment regardless.
Pretty much every bad guy in Xenosaga has a legendary weapon.
The heroes have very little in comparison.
Skies Of Arcadia. The main villain, Ramirez, has a sword that lets him cut through reality itself.

Gilgamesh from FFXII has a collection of swords? Wait, what? Bloody hell, no wonder I keep mistaking him for the Fate Stay Night character... Who also has a collection of swords and one really powerful one. Ironically, that version gets his ass kicked by Shirou using the copies.

The legendary Zankouken sword in Mitsumete Knight R is an example of sorts.
The game's protagonist Captain MacLeod is sent in a mission to find it (along with the King-curing item "the Tear of the Star") by his superior, the general of Orcadia Kingdom, so the Kingdom can become all-powerful. In a normal playthrough, you won't find that sword: but, upon your 3rd playrthough and if you pick a certain item at the beginning of the game, near the end of the game when MacLeod will discover the truth about the atrocities commited by Orcadia, and will go rogue, you'll discover the sword was with his mentor Ramirez all along, and he'll oppose you in your way to defeat Orcadia's general. Once you kill him in duel, you retrieve the Zankouken.
Off topic, but the greatest quirk about that sword ? It needs a special condition to activate its tremendous power: You need to cut down with it your loved one, meaning that if you managed to make one of your two female travelling partner your Love Interest, you'll have to choose killing her or not before fighting the super-powerful general.

Well, what if the bad guys already did this, and they're the ones with the legendary weapons of the world?
And you'll have to fight and defeat them to get them!
