Knowingly having sex with someone who is too inebriated or incapacitated to consent clearly ''is'' rape, but two inebriated people engaging in consensual sex that they may regret and might not even remember just as clearly is not. The facts that were presented don't rule out either possibility or the wide range in between. However, an implication that the producers may have had a hand in orchestrating Bay's deflowering--with or without the knowledge of Honey's eventual father--points towards sexual assault and turned off some readers.
