Chicago cop sues the family of the teenager he shot and killed. For $10 million in "emotional damages."

The Chicago police officer who killed Quintonio Le Grier has filed a lawsuit against the teen's estate. In a counterclaim filed last week and posted on the Chicago Tribune's website, Officer Robert Rialmo alleges that the 19-year-old whom he shot dead the day after Christmas assaulted him with a baseball bat and caused him to suffer trauma. He's seeking more than $10 million in punitive damages from Le Grier's estate.

Authorities have said Le Grier died from multiple gunshot wounds after the December 26 shooting. His 55-year-old neighbor, Bettie Jones, was also killed. Police have described Jones as a victim who was "accidentally struck and tragically killed." They've described Le Grier as a "combative subject."

Le Grier's father and Jones' family have filed wrongful death lawsuits over the shooting. The officer's lawsuit says Jones' death was Le Grier's fault, not his. "The fact that Le Grier's actions had forced Officer Rialmo to end Le Grier's life, and to accidentally take the innocent life of Bettie Jones, has caused, and will continue to cause, Officer Rialmo to suffer extreme emotional trauma," the lawsuit says.

The shooting came as Chicago officials were in hot water for what critics have slammed as a police culture of "shoot first and ask questions later." As details about the case emerged, Mayor Rahm Emanuel said there were "serious questions" about what happened and ordered changes in how city police officers are trained to handle calls involving people who may have mental health problems.

Rialmo's lawsuit gives the officer's side in the controversial case, saying the officer opened fire after Le Grier "took a full swing" at his head, "missing it by inches." "He told me that he felt the breeze of the bat passing in front of his face, it was that close," attorney Joel Brodsky told CNN affiliate WBBM. In a statement on Facebook, Brodsky said Rialmo "was taken aback by the speed in which the family of Mr. Le Grier rushed to file a lawsuit."

"He wants to make the point that having a relative killed in an officer-involved shooting is not the same thing as winning the lottery," Brodsky said. "Only the few cases of truly excessive use and abuse of force should be subject to legal actions."

Bill Foutris, an attorney who represents Quintonio Le Grier's estate and the 19-year-old's father, said he had a good reason to file a lawsuit against the city quickly: preserving evidence. "As a result of filing the lawsuit quickly we have gotten well over 40 DV Ds of evidence, including police cams and police reports — all things we would not have had if the suit was not filed when it was," he said. "It would have taken six months to get some of that evidence."

The officer, Foutris said, is trying to steer the conversation away from what happened that day. "This counterclaim is an attempt to deflect from what the officer did," Foutris said. "He shot a teen four times in the back."

Chicago's Independent Police Review Authority is investigating the shooting, which happened after officers responded to 911 calls from Quintonio Le Grier and his father asking for help. Rialmo's account of what happened that day contrasts with descriptions of what occurred in the lawsuits filed by the Le Grier and Jones families. Antonio Le Grier told CNN he called police after he heard his son banging with a baseball bat on his bedroom door. The father told the Chicago Sun-Times that his son had been prescribed medication for emotional problems.

"I wanted someone to try to help him with whatever he was going through," he said, "because I was not trained." After he arrived at the apartment in response to a dispatch call of a domestic disturbance, Rialmo says Le Grier swung a bat at his head multiple times when they were several feet apart. The lawsuit says Le Grier repeatedly ignored Rialmo's orders to drop the bat.

Eventually, the lawsuit says, "Officer Rialmo reasonably believed that if he did not use deadly force against Le Grier, that Le Grier would kill him." The officer didn't see Jones, his attorney says "because the sight of her was blocked by Mr. Le Grier, who was standing over the officer about to crack his head open with a bat."

Basically Bundy's home was an armed camp and as far as I recall still is so they couldn't get him. Nevada is not exactly a bastion of common sense law and order either. His stand off stuff wasn't that long ago and statute of limitations is still good on him. Honestly I am glad this didn't turn into another Waco or Ruby Ridge which led to an explosion of these Militia idiots the last time it went sour.

The Federal Indictment against Ammon Bundy, Cliven Bundy, Ryan Bundy, Ryan Payne and Pete Santilli slaps them all with a minimum of 16 felony charges apiece. This is just for the 2014 stand off the Bundy's kicked off.

The charges are as follows.

•1 count of conspiracy to commit an offense against the United States •1 count of conspiracy to impede or injure a federal officer •4 counts of using and carrying a firearm in relation to a crime of violence •2 counts of assault on a federal officer •2 counts of threatening a federal law enforcement officer •3 counts of obstruction of the due administration of justice •2 counts of interference with interstate commerce by extortion •1 count of interstate travel in aid of extortion

The maximum penalties for each of the charges against the men range from five to 20 years in prison. Each charge carries a maximum fine of $250,000.

If convicted on all charges each of them could face 80years to 320(life) and a possible max fine of 4 million dollars.

These "Sovereign Citizen" style loons appear to have finally bit off more then they can chew.

There may be other charges pending for the occupation of Malheur but there are no details in that regard just yet.

Eh, it's one thing to get riled up over getting slaughtered by the FBI like it was Ruby Ridge or something but it's another to start shooting people because their members were tried in open and fair court.

They've got nothing to justify anything this time.

I will counter that with the fact many of them expressed a fear of being arrested in general. Any of them roaming outside of the armed camps have apparently realized they are not the 'Untouchables' they once though they were. That will just as likely take the wind out of the sails of all but the worst of the die hards.

There's are levels of crazy, this won't be enough for many of the only marginally crazy ones.

You can bet that the crazy ones won't be going anywhere apart from in large armed groups from now though, the lesson they will take from this is that the Feds never miss a chance to bring the iron boot of tyranny down upon them.

Sounds like an intimidation tactic to get the family to drop their suits. Luckily, if the judge agrees, they could award legal costs. I don't know how often that happens or what the bar is though.

There comes a point when a person's criminal acts are so grand that our legal system doesn't know how to deal with it. 320 years in prison is basically an Outrage Overflow Error. It's gibberish, like sentencing someone to be prodded by unicorn hair and then exiled to Mars.

This. If they were willing to just start shooting up police stations or such, they would have been doing that already. They wanted a fight, but they wanted the government to pick it. They wanted federal agents kicking in the doors and firing M16s at them. They wanted to be the heroic freedom fighters defending themselves from government oppression.

I don't think they're capable of picking the fight themselves because it would interfere with their internal narrative of being the heroes.
