It never even occurs to the bad guys to try to restrain them by nonlethal means.

It can be argued, based on some statements made by the Doctor, that the fact that it is somehow tied to the humanness of humans suggests that it might be a the Time Lord technology seeded on Earth to cause the evolution of something the shape of humans (and Time Lords). This could also explain why it was able to change Jack's condition, as the Time Vortex was also accessed by Time Lord technology to empower Rose to (among other things) cause Jack's condition.

At the end of the third episode, Jack confronts Danes about the girl he killed, claiming that he knows Danes doesn't really feel regret for it -- and Danes admits that Jack's right. Not only does he feel no regret for what he did, he claims it was ''the best moment of his life''. * ArtisticLicenseGeography: A minor example, but Buenos Aires and Shanghai aren't perfect antipodes, nor are they even the closest antipodes in the two countries. Better examples would have been Beijing for Buenos Aires or Salto, Uruguay, for Shanghai.
** In "The Blood Line", this is lampshaded, as the Family member in Shanghai says that they're antipodes "give or take a hundred miles", and blames it on the fact that the Earth isn't a perfect sphere.
* ArtisticLicenseLaw: There's actually precedent for what happened with Oswald Danes. In New York state, a man was executed...only to have not actually died. He argued that his sentence had been carried out (he may have been actually declared dead), but the court ordered the state to zap him again. They did so, successfully this time. Under the circumstances, a commutation of the sentence to life in prison without parole would've been more likely.
** Another possibility, even if Danes won his threatened suit, would have been civil commitment. Kentucky does have such a law.
** As Danes says in episode 2, he's free only on "the most beautiful technicality" - something in the state's constitution about "acts of God" - and people are working to get him a life sentence even as we speak.
** And of course, at the end of the first episode, Rex Matheson's 'rendition' of the Torchwood team. He cites US law, not British law, and has British police taking his orders in forcibly removing a group of British citizens from Britain. That's just regular extradition.
*** He cites a law called "456". Considering that the events of "Children of Earth" were international and wound up being a total clusterfrak on the UK's part, and that there's already a professional relationship between America and the UK when it comes to paranormal and extraterrestrial incidents (via UNIT), who's to say Rex isn't citing a brand new legal agreement between the two countries that's supposed to cover situations exactly like this one?
*** Rhys also lampshades it when Gwen complains that she's a British citizen, summing it up as, basically, "He's American, they do whatever they want."
