By the same logic, a Chaotic Good person would also not kill an innocent girl in cold blood. Whilst Shioru is not willing to kill Sakura, he does not just let the Earth be destroyed. He tries everything he can to save the world and her, at great risk to himself, which is clearly Chaotic Good (he protects others, but he does it his way). Murder (or, indeed, killing in general) is an inherently Evil act, and thus you cannot claim that someone is not Good for refusing to do it, no matter what the circumstances. It's not different from Batman refusing to kill the Joker, even though there is a good chance that he will escape and kill again. It's not necessarily the right thing to do (that is a matter of personal opinion), but it's not an Evil act, and thus does not affect Shirou's alignment (which is quite clearly Good, because he puts others before himself and tries as hard as he can to save lives).
