Think it was more a legality thing. Fox had the TV rights to Batman, not the whole of DC comics. I'd wager that CW had/has TV rights to Zatanna. Same reason they couldn't reference Alan Scott even if it would have fit tonally.

I wish they had done more with that Legion of Doom thing they were implying near the end so Scarecrow could do more.
