Have you any dreams you'd like to sell?I'm a little unclear on copyright, but from what I can gather, to not infringe on copyright and to fall under fair use, they have to be first, transformative and second, have to add something to the original.
Which people like for instance, Jinx, are not doing at all. All he does is record himself watching a video in its entirety and adding little to no useful commentary on it.

what do you mean I didn't win, I ate more wet t-shirts than anyone elseI do not know who is Jinx is. With Team Four Star, however, I think it's under protection, because they not only do new voice over work for it, they also have edited entire scenes differently than the original.

That's actually why it took years for the Gamera episodes of Mystery Science Theater 3000 to get put on DVD, and why they still don't have the two Godzilla episodes on DVD.

They've almost purged not just You Tube, but almost every other video site in existence (including Vimeo and Dailymotion) in their attempt to, for whatever reason, remove The Beatles from being listened to outside of the VEVO channel that only has a few of their songs on it.

Meh, pulling actual copywrited music is fair enough, in the end it is being illegally uploaded. But pulling legitimate transformative works and even censoring what amounts press criticism, for search rankings, that's batshit.

He's had a lot of bad blood with Atlantic Records that the music video for White and Nerdy has him editing their Wikipedia page to read "YOU SUCK" (yes, in all caps).

Have you any dreams you'd like to sell?That's not the video being legal, it's still an illegal upload, however the copywrite holder can choose to monetise the video and take the money if they want, why they sometimes do that and sometimes issue a takedown I don't know.

Like, if you didn't want people to do that in the first place, show some consistency.

But yeah, youtube's Content ID and Copyright claim system is total bullshit. Jim Sterling has been complaining about this stuff for years. As long as someone can make claim with no possibility of consequences they are going to keep doing it.

It's one thing to make a spectacle. It's another to make a difference.Nope, it's not a problem with the law, it's a problem with You Tube, You Tube could change it tomorrow so that after X number of false claims any claims you make have to be approved by a person before a takedown, or after suffering X number of false claims claims against you no longer result in an automatic takedown.
