That's not really an example; Snidely Whiplash getup aside, Spike isn't a villain.

He is one in the episode that`s from. As much as we`re evidently supposed to pity Spike, trying to frame another character for anything is morally wrong.
(On a sidenote, do we have a trope for temporary villainy in a character who is otherwise usually good; or at least on the same side as good?)
EDITED IN: Speaking of harmless villainy, I think the Ineffectual Sympathetic Villain page image would be more convincing without the bottom panel, which makes it look like Batman is running away.

Just because he does something morally questionable doesn't make him a villain. And it's kinda hard to tell what he's even doing if you don't know the context.
