Splosion Man Devs don't have the money to sue.
Looking at the two games, I'm not seeing Capcom's game as that much of a ripoff compared to Splosion Man, at least compared to Platform Games in similar subgenres, like the Metroidvania or the Mascot with Attitude Platformer.
This is pretty evident in the existence of Explodemon during the same time period as Splosion Man that "Platformer Where Your Character Explodes" was going to be a subgenre.

This is nothing new. Developers have been copying other games and releasing them for iOS devices ever since they were released. And as long as they aren't plagiarizing or directly competing with the original product, why care?
OP: No. As long as Capcom didn't directly copy or recreate Splosion Man's assets, there is nothing they can do about it.

Actually they ripped Megaman off with Zelda, they only changed the scenario, the story, the gameplay and the graphics so that nobody would notice it.
