- Ginyu's ability is loud and easily noticed.
- Vegito does not give a frack about magic and probably knows a thing or too about counteracting it.
- Dragonballs are readily available and Goku/Vegeta someone outright told Pan "go and fight that murderous psychopath, even if you die you'll just be brought back to life."
Ginyu's plan will fail at every level.

Not sure how I feel about the theory, but it did lead to me an interesting topic of conversation... what happens if Ginyu dies in King Cold's body and someone wishes "Bring King Cold back to life?" Would it bring Cold's body back with Ginyu inside it, or would it bring original flavor Cold? This is compounded by the fact that Cold may be alive in another body. Or what if they wish for "Ginyu to come back?" Would he come back in his original body (whatever that may be?), or would he come back in Cold's body?
Now, this is mostly irrelevant since the wish at this point would be "bring back everyone killed in the tournament" so presumably it'd bring back Ginyu-As-Cold, but it's interesting to ponder.

It is easily noticeable yes.
Vegeto has shown no particular ability to counter magic on others, and in fact has been affected by magic every time someone tried it on him. He did get turned into a candy, and he did get teleported to another dimension; the only reason he didn't stay stuck as a candy is because Buu ended up reversing it himself and breaking out of pocket dimensions is a thing you can do if you're powerful enough.
Why would Ginyu's plan fail if his plan is just to participate in the tournament? The others would have no particular reason to attack him for the precise reason that Bra would be back by the end of the tournament anyway. Vegetto's had to swallow a loss because of a magic trick, there's no reason they would suddenly explode and try to murder Ginyu for winning via a magic trick, especially if he says he'll give the body back after the tournament.

For the very reason that they can force him if he doesn't? They've put up with worse things this tournament than "Bra's body is possessed for a couple of hours".

He isn't.
It never was revealed (we've had no new info on Ginyu since Buu said he was alive), people were just speculating he was because Cold's shown the most difference from canon. I decided to run with the assumption for the sake of discussion.

Goddamnit Bra stop being such a brat! I would be OK with her beating Cold if she got some needed Character Development from it. That'd be great; she'd learn not to take her own power for granted. But after using a cheap tactic with Senzu Beans she's just as arrogant as usual, totally ignoring the fact that arrogance almost got her killed. Okay, I will admit, this is starting to pique my curiosity. She suddenly seems unsure about herself when Gohan complimented her on being strong.
On the Ginyu topic and people saying it's smarter for him to wait...why? Assuming he's Cold (a fairly big assumption, if a reasonable one since Cold's shown the most difference from canon), if he just takes this attack then he's in a healing pod for an unknown amount of time or dead, which might make him miss his chance at the dragon balls entirely if he doesn't recover before the tournament is over. Not to mention that his universe have so far had zero luck trying to get to the Dragon Balls.
If he wants to get the them according to the rules, then here are his options among the remaining participant:
Raichi, whose technology he wouldn't know how to use making him a non-option.
XXI, Gast and Buu who all have weird magic that might block the change entirely for all he knows. (And taking XXI would be useless since Ginyu wouldn't know how to use magic.)
Leaving Goku, Vegeta, Uub, Cell and Bra as the only real options. Of those five Bra's shown the most raw power and since Bra's match would have just ended he would get the maximum amount of time to get used to the body (and if he can do it stealthily he could just mutter something about training).
Seems to me like changing now would be pretty much his best option. And if he blows his cover, so what? He can just tell Vegeto and co that he defeated her using his technique and promise to give the body back after the tournament or something, and the people from his universe are non-factors compared to her even if he doesn't immediately know how to power up..
