That's a fair point. In the case of a Sequel Hook there's some doubt that it will be written, so that can be a The Bad Guy Wins. "The Empire Strikes Back" is not a The Bad Guy Wins because we know there will be another part to the trilogy that turns things around. This case may be similar.
