Both pics are ok, but I agree that they could only work in combination with another pic that shows he's an immigrant. Not everyone has watched The Simpsons, not everyone knows who Apu is.

So-so at best, I was inferring immigration status from the hat skin colour combination - came off as Hispanic to me.

I'm not particularly keen on either, but 1.2 is slightly better because the background demonstrates the Patriotic aspect more clearly.
