Now that would be true if the man was an independent. Judging from his age and the fact his mother dropped him off he was a dependent, which means he and his family are indistinguishable from each other in such matters.

He was a negligent idiot. Even a judge agrees on that.

The family of the injured deserves compensation. This wasn't some tragic accident which noone could see coming, this was an idiot endangering other people.

[up] this case was from 2008. He ran in front of a train so he wouldn't miss another. Read the article.

At its heart, this case is about someone using the tragic death of a teenager to pump his mother for money. If that doesn't disgust you, then I don't know what to say.

At it's heart is the story of how one family had their grandmother suffer serious medical injuries because someone didn't want to be late. I feel bad for the teenager and his lot, not a lot but it is there, but I also feel for the family who had to pay god knows how much in medical bills and the elderly lady who had a fucking corpse crush her.

I don't care whose fault the accident was. The point is that to drag the mother through a court proceeding where she will be constantly reminded of her teenage son's brutal, gory death just so you can line your pockets is an exercise in cruelty and self-absorption. Shame on the plaintiff.

Plaintiff has elderly grandmother as a dependent. They are at the poverty line. They can barely afford living as it is. The grandmother is massively injured due to no fault of her own. They have insurance and can pay off most of it, but not all and definitely not the cost of the hike in insurance or worse they don't have insurance. Is the story squishy freely for you to stop thinking as the plaintiff as some sorta demon idler?

And key, judging by the fact that he was 18 and being dropped off by his mother probably means he was a dependent of the family, meaning that, yes they could be sued...

Either that or he had a will that the family excepted.

People are lawyer-happy. The train company wasn't liable, and the plaintiff was hungry to sue somebody.

I don't think the plaintiff is a demon, just a thoughtless, selfish individual, and the facts that we know of bear that out.

I would not dream of filing such a lawsuit if I'd been in the old woman's position. To know that someone was ripped to shreds by being hit with a train and to only think about how sad you are that you were adversely affected is reprehensible.

I'm aware that it is within the realms of possibility, but I'm not talking about that... I'm talking about a family who has lost a loved one. And I assume that an 18 years old guy can take care of himself.
