I don't suppose Obama can use executive orders to get a new justice pointed. And as others have said, the Supreme Court's status as a non political organization went out the window a looooong time ago. Probably with Marburey vs Madison.
I Bring Doom,and a bit of gloom, but mostly gloom.I'm a bit worried about what this could mean for the TPP. From my understanding, it can't be brought up for a vote right now because Republicans in Congress are too scared of the ramifications of voting on it. Couldn't Obama use his nomination as political leverage to get the TPP passed? You know, like nominate an ultra-conservative?
Actually, according to wikipedia he can make a Recess Appointment when Senate is in Recess. It only lasts until the end of the next senate session before it needs to be confirmed in full.
Honesty, I can see Obama do that as final "Fuck You!" to the GOP if they are too asinine about it.

The GOP will just hold pro forma skeleton Senate sessions to prevent that from happening. Because why should government be able to function, right? Right.

I'm actually wondering if that isn't what breaks the situation. A moderate-slightly lefty Appointee who could be swayed by the argument gets appointed instead of Obama spending the next Winter sneaking the most radical leftist judge he can dredge up through.

I think "celebrating" his death is in poor taste but unless you were actually his family or close friends there really is no other way to talk about it other than in political terms. And if that means you think good things can come from it what else are you supposed to do? Pretend you don't feel that way?

Have you read the things Scalia said during his life? The man was a walking cartoon racist supervillain. I wouldn't pop champagne at his funeral, but I wouldn't mourn, either.

Scalia was said to be a very warm and amicable man personally, and there must have been something that made him and Notorious RBG friends. So I'm sure many of the people who knew him will be grieving, and my condolences to those people.

That's probably the closest I can give to anything like a classy send off for the man.

I'm not gonna be popping champagne and dancing in the streets, but the sad fact is that this is a good thing – a man who tried to harm me and mine can no longer do so. That's on Scalia, not me.

Exactly. One regards Scalia's passing the way one might a serial killer's. Yeah, there's kind of a generic sadness that a person died, but other than that...

Trump delenda estIts not like the left is going to go Westboro on him and protest his friends/relatives while they mourn. But Scalia did a crapton of harm to a lot of people in the name of ideology, and his death provides an opportunity to reverse that.
Politics is the skilled use of blunt objects.
As long as people aren't gloating about his death, i don't see the problem about talking about the implications it has for a better America.
Guy lived a long, full, successful life anyway, so it's not like his death was caused by anything untoward.
