Anyways, I'd probably get this one if it did play somewhat like Magic, since I've had experience with that game.

Correct me if I'm wrong but wasn't the issue with Scrolls that Notch was filing a trademark for all sorts of things and it theoretically threatened the TES license as a result? At least that was the defence of Bethesda's lawsuit that I'd read somewhere.
But I wouldn't be surprised if it was just Bethesda lawyers/Zenimax going apeshit over nothing.
and Blame U.S. copyright laws for that. If Zenimax/Bethesda didn't file a lawsuit against Mojang because of the similar title, then other companies could use that as a justification for ripping off Elder Scrolls in the future. Zenimax didn't have to win the suit, just file it - in order to show they are willing to defend their copyright in court. Heck, many other companies have done this before - just hidden from the public sphere.
tl;dr Blame the copyright laws for this whole mess. Please correct me if I'm wrong.
