If you think Kinetic Balls is viable on the PS 3, why don't you buy a Dev Kit and make it yourself?

^^ Uh, where does it explicitly say in black and white with no other words "after the first Rebate payment any and all future payments are terminated"? Because thats the only thing that would give the proof you claim you have, as distinct from a lack of clarification?

Nowhere does it say that. Nowhere did I say that after the first check, no further checks would come. Quarterly royalty checks would keep coming so long as the product sold... But that does not guarantee 100 percent return on cost.

Nowhere does it "explicitly say in black and white with no other words" "All development costs are 100% guaranteed to be repaid to the developer by Sony." And until I see that as proof of your claim, we're at an impasse.

@Story: I was making a point that not all iWhatever apps were commercial, and the same can apply to any platform that hosts user-made content.

The dev kit for the iPhone costs $100/year, which a hobbyist can afford if they are sufficiently motivated.

But they don't even have to pay that much. They can jailbreak their phone, and use a homebrew SDK. The only limitation is that they can't sell such applications in the App Store. If they then develop something they want to sell, they can buy the SDK and submit their app through the official process.

So what's wrong with being allowed to jailbreak a PS 3 in the same manner?

A hobbyist doesn't always need a professional camera, and they could well grind a lens themselves. And you can write and direct your own play without having to pay anybody.

^^^^ Not really. Especially since I'm not saying Let's See You Do Better. I'm questioning, if it's so easy and cheap to create a successful ap on the PS 3, why isn't it being done?

You don't a good guitar to write music or a good camera to just take pictures, so why do you need a full blown dev kit for a hobbyist who has no plans to break into the industry? Why can't they just use LBP 2 or a free engine or kit on the PC?

You can make apps on the PS 3 if you truly wish to, however as I said before not many on the PS 3 really cares for or wants things like "PS 3 Balls" or similar apps because they don't use their PS 3 for that. You and many others were arguing that the lack of a full dev-kit for the PS 3 was a problem for the people wanting to homebrew on it, and as you said yourself, if it really mattered to them they could just get a loan and buy some dev-kits, is that particularly hard? Well I don't know it depends on if you actually know how to program and how good your credit is, if you don't have either I wonder why you want to develop free apps on the PS 3, but that's something different

But to touch on the original topic: '''if jailbreaking the system is not allowed, what remains besides the official dev kit? "Just using LBP 2" means that they're limited to whatever the LBP 2 developers put in the engine, instead of by their own abilities. Also, they learn precious little about how a game engine actually works.

An artist shouldn't be forced to paint-by-number just because they can't afford hundred-dollar paint tubes.

(And a loan is useless for homebrew, since you aren't making money back.)

SCEA maintains the suit is valid because Hotz logged on to the PSN under the user name "blockmanic." However, Hotz's team points out that there's allegedly no evidence blickmanic is Hotz. In fact, the machine that blickmanic used has a different serial number than any of the machines Hotz presented to the court, the filing says.

That's a pretty terrible typo.
