Maybe, if we ever knew what really happened rather than what little we learn from Tousen himself. But if we use this trope to justify murder every time the system breaks down, we'd have one very degraded trope.

There is no conflict. The hints about his true motives were there early on and the "justification" for his behaviour remained to the end. He was also never The Mole.

Again, this is a misunderstanding of how the trope works. It doesn't matter if the opponent is defeated despite their powers; that's judging the battle by hindsight. The point is that the powers do not fight the hero on even terms, or are presented to the audience as a major advantage. There is no way Aizen doesn't qualify as both.
