Only discusses it, plus it doesn't even show them below the waist; for all we know, she's pantless. It doesn't have to be just pants missing on the guy (if you want to make sure it's just about clothing in general), but it should at least show their full bodies.

Maybe pair the naked-except-shoes-and-gloves Sonic next to the fully-dressed Amy?

The current is in Keep Until Better Image Suggested territory, but I'd definitely prefer something that shows the whole characters.

[up][up]You mean they can't trademark the characters. Copyright works differently. If you create something based on someone else's character, then both you and the original creator have a copyright stake in the work.

I'm not a copyright lawyer so I can't give you the ins and outs of the situation, but the above is the basic idea.

^^ No, it's sort of not okay to use someone else's characters at all, but since the deviant artist isn't making money off it they generally get left alone. Making it so others can't create things based on your intellectual property without permission is the whole point of copyright law.

[up]You're right in that officially and legally, you're not supposed to use someone else's characters without permission under copyright law, but that doesn't prevent you from obtaining a copyright over your work depicting the copyrighted character(s). It just doesn't override the original copyright, and the original copyright owner has the right to force you to remove your depiction from public view.

I did say it was complicated and that I'm not a copyright lawyer, so that's probably the best I can do at trying to explain the tangled web which is copyright law.
