Nah. Harmony Gold can't touch them this time since they've put out their own (better in some cases) versions of the contested elements. Besides, MW (not Btech) has done well enough without Macross/etc. ripoffs or at least they didn't lose anything by not having them.
The Unseen ban only applies to slightly over a dozen Mechs now anyway.
@Stevebat; well all the other games (sort of) followed the timeline set up by the tabletop games/novel series.

The Mech Warrior series followed (in a rather liberal sense) the Battle Tech canon.
Well, the 1st game took place during the 3rd Succession War, the second during the Clan Invasion (with expansions taking place slightly before and after), the 3rd during the end of the Clan Invasion, and the 4th (and its expansions) took place during the Fed Com Civil War.
This game is reverting back to the 3rd Succession War; thus a reboot of sorts.

Considering how badly Front Mission Evolved hurt me, I don't know if I can get excited about a new Third person mech game... Then again, it's <BLEEP!>ing mechwarrior.
I think it has more to do with the fact that they're apparently dropping the numeral, so it'll be the 'first Mechwarrior' for newbies.
Speaking of FME, I'm currently playing it after getting it cheap and while it's not a classic in any sense it only burns in its butchering of everything FM. It's pretty decent on its own especially since the cutscenes can all be skipped, and installing it is why I now have Steam on my PC- which is good.
(By the way, I played MW 4 mostly in Third Person mode and I'm a former AC nut so a view change isn't that big a deal for me.)

No fun designing an awesome Mech and then getting an orbital strike dropped on your head, a nuke wiping out your objective and your HQ getting struck by nerve gas.

Area specific mech health, with the potential to ruin subsystems, and ammo detonation. Heat / coolant management Mech customization and scavenging, a market, or mercenary contract system
Because those things were kind of hard to wrap your mind around at first, and descision making, thinking, and losing badly because you failed at any of those, are no longer considered contemporary.
What I'm afraid we'll see:
Unreal 3 engine Regenerating mech health Simplified mech setup, possibly none
Well, I doubt we'll see a mercenary system (unless it's you doing the hiring) because the PC apparently works for a Successor State.
I really don't thing we have to fear about regenerating health (these are the same guys who came up with Battle Tech); unless there are in field repairs available.
