Except they are going to drop the trademark! Why go to court?

...Let me try again; they offered a compromise, that didn't end with them dropping the trademark, so Zenimax is taking them to court to scrub them out.

"Mojang's application is a "standard character mark" application aiming to protect the word or phrase in question rather than a stylized logo. In a worst-case scenario, Pitts argues, Mojang would be able to claim ownership over the word "Scrolls" and its use across a variety of media, not just games. This, he suggests, puts Bethesda's upcoming release of Skyrim, or more correctly, The Elder Scrolls V: Skyrim at risk of legal action from Mojang."

Read the article on the other end of that link.

What llink? And I haven't read anywhere that didn't say Mojang wasn't dropping Scrolls copyright.

Without the word "Scrolls" being copyrighted, what's to argue? Why go to court?

The chucklefucking trademark!

Here's a Kotaku article: http://kotaku.com/5846111/mojang-v-bethesda-or-i-hate-it-when-mommy-and-daddy-fight

Here's the one I just posted: http://www.gamepro.com/article/news/223591/bethesda-refused-trademark-compromises-with-mojang/

They never offered to drop anything, they offered to append a subtitle, which doesn't really solve anything.

and give up the trademark.

THERE IS NO TRADEMARK. If Zenimax took the offer then there wouldn't be a reason to go to court.

"it's not a fear of us having a trademark on the word 'Scrolls,' as we've offered to give that up."

Both articles say Mojang is willing to give up the trademark.

Wait, I saw that Kotaku article you were talking about. Now I'm stumped. But to be fair, it's probably just a papertrail issue.

...or a very high stakes game of Quake.

Exactly. Whether this is just a money grab or trying to stomp the competition, which isn't really competition at all, it's malicious. This gets ridiculous each day.

If I were Zenimax I would have taken Notch's offer of a Quake game. Bethesda could easily hire some pro gamers and stomp them at it.

I doubt it; it's probably just them trying to get a lawsuit under their belt anyway. They probably don't expect to win anything.

This is exactly why this type of thing doesn't usually reach the public eye.

Yeah, this is ridiculous. (And who said that Scrolls is coming out the same day as Skyrim? It was Minecraft that was originally supposed to come out then, and they moved it a week later.)

[up] Based on Google results, Scrolls isn't coming out anytime soon.

Wow-

I am not exactly sure what side should I take on this time around...

On one side, I read all that was posted and I think I should favor Bethesta (And the other, whatever... even if I dont like any of its games. Althougt that shouldt matter...), PLUS, I am a Notch hater as well (Ya know, the classic "Notch = Lazy"), so that gives me even more reasons to be on Bethesta/Zenimax Media. OTHER PLUS, I just hate it how people ALWAYS thinks than Mojang/Notch are the poor victims simply because they are indie. FUCKING SUCKS...

On the other hand, solving this with a quake match?... I still hate Notch for being lazy and uninterested with his own games, but damm, this just show he can definitivly be amusing when he wants, even in a serious case, LOL.

EDIT: Althougt now that I think about it, it also shows than he could be a lot better if he wasnt that lazy...sad.

So... I am more of the Bethesta (And the otherĀ“s) side, I guess...

[up]I'm not sure that's the best way to decide who to side with in a court case. It seems kind of petty to be against someone because they don't pay "enough" attention to a game when Notch clearly pays plenty attention to it. But to each their own.

[up] Yeah I know.

I am not accusing Mojang of begin in the bad side solely for that. In fact, it is a really bad way to determine that.

What I tried to said is than even if I didnt knew both, for what I DID read in this five pages thread so far, Its seems like Bethesta is in the rigth (By the way, every time I say Betheste I am also refering ot the other guys), but, then again, I may be on the wrong...

About the hatting on Notch is something completly unrelate, its just a simply bonus for me ;) (but I try not to be biased).

Well anyways, its not like anything that its written here will somehow affect the court...

Also, I blame my English if something came up wrong.

Wait, you hate him for being lazy?

What, you want him to update the game everyday? tongue Do you have any idea how unrealistic that is?... You don't really have any clue how making patches and adding stuff works, do you?...

I don't even see why this case is such a big deal. Like someone said earlier, this kind of shit happens all the time.

The only reason why this particular case is such a big deal, is because Notch is making it a big deal.

I thought November 11 was when Minecraft was supposed to be out of Beta phase.

In any case, I think Notch mentioned on his Tumblr that they'd call expansions for Scrolls stuff like "Banana Edition" or something, but Zenimax/Bethesda apparently didn't think to compromise/settle.

Of course, Notch could just rename it Smashing Pumpkins Into Small Piles Of Putrid Debris.

[up][up] The hell are you talking about? Notch has been taking it pretty well, even wanting to challenge Bethesda in a game of Quake.

He's talking about the way Notch posts it all over Twitter and his blog. Some of his blogs and Twitter posts are kind of hostile, and really seem to be trying to enforce the whole martyr image he's got going. Even though he's deleted and apologized for them, he's still stirred up a shitstorm.
