That and enough of the right-wing Court doesn't want to dirty their hands with it. As if they rule anything on it any further, it'll probably drag them into political-cultural circuses they don't want to be dragged into.

The clear weight of both the Constitution and lower court precedent is on the side of gay marriage rights, and I can't imagine that Scalia and the other conservative justices want to be publicly associated with making it legal across the entire U.S. Why, they might lose their membership at the Wealthy, Angry, Bigoted White Male Club.

Reality having a liberal bias, full legalisation of gay marriage across the western world is inevitable. The more liberal US states are forcing the matter upon the conservative ones whether they like it or not, though until we see a true Deep Red state, like Arizona (any of the ones beginning with A really) there is still work to be done.

Yeah, if Texas' ban is affirmed, the Court will probably have to take the case. If all 50 states get it by the Circuit, then the Supreme Court can just shrug and say that it happened, and Scalia won't lose his Cranky Old Man status.

Yes it's better off that this is decided on a state level rather then pushed on from high. Marriage equality will (slowly) become the national wide even with out the big day in court it's supporters may of hoped for.

Because I know it won't change things here in the Deep South. The court decision may as well have happened in a foreign country.
It will take the federal appeals court to make it work here. It will be hard, but we will get it.

Cruz: Amend U.S. Constitution to Preserve Marriage Bans
If Cruz wants to take a dump on the Constitution so bad, why doesn't he just buy a copy and do it on his own time?
Better yet, if those opposed to equality really had a case, why didn't they do a better job of defending it than saying "the law must stand because reasons"?

I just saw the headlines on that one crawl across my feeds. Fantastic news; it means that SCOTUS either doesn't want to issue a sweeping ruling or is satisfied that the federal circuits will eventually make gay marriage legal in all states without intervention.
