The situation hasn't been resolved yet, via Deus ex Machina or otherwise, so it doesn't meet all three criteria.
Although I haven't watched episode 13 yet. Ok, watched it. Yeah, not resolved. Probable as it may be, until Invictus is actually defeated by some contrived shenanigans or other, not an example.
