Yeah, I think that's stretching the point of this scale a bit too far. Oz is entirely about normal humans in the prison system. No superpowers, no magic, nada. For instance, Governor Devlin may hold the highest power of any character in the series, but that doesn't mean he can rewrite reality or affect events on a cosmic scale. No-one should be over Type 1 by definition, so it falls short of the four type limit.

In regards to Doctor Who:

I haven't seen the show, but it seems a bit odd that four different characters are all listed as Type 7s. Is it really possible for that many characters in the same story to be absolutely and utterly omnipotent? How do they relate to each other in terms of power? Can each of them all impact all of reality without depriving the others from Type 7 status?
