I do find one thing curious, based on the judge's statement and the actual law cited:

If there was only the one count, and the maximum sentence for that class of crimes is four years, how would the judge sentence an individual convicted of the same crime to ten years?

Maybe he meant that's what he personally thought would have been fair, as opposed to what's on the books?
