Probably the worst area for underhandedly upscaled HD, aside from cable TV, is Blu-Ray.
This is just like when 70mm came in during the '50s, and there were a ton of 35mm blowups, or the insultingly bad digital projectors nowadays (the worst example being IMAX theaters cut down to 2K, in other words 1080p TV resolution!). I agree truth in advertising is needed.
When they said "only films made to be 3D", they meant live-action films. Converting Toy Story to be real 3D is relatively easy, and it's just as 3D as a freshly-made all CGI 3D film.
I've read that 70mm blowups from Super 35 (such as Terminator 2, True Lies and Titanic) tend to be quite good and you get added picture as well.

They only regulate HD for broadcast channels because the airwaves are considered to be public property. What cable channels or movie theatres do is their own business.
