Bumped, because Videogame Cruelty Potential was bumped.
We often use panles of webcomics without the author's permission. I don't see any reason for a different approach just because we use by chance the panle next to the copyright symbole.
I believe in another thread that Eddie said that as long as we're only using a piece of a copyrighted work, it's fair game...IIRC it's the Fantastic Racism IP thread if you wanna check for yourself. I like the vertical arrangment pic.
That's pretty much a strict improvement over the current one since it's within the size limit, so I'll swap them. (Previous◊)

As long as we're not using the entire strip, cropping the copyright notice out isn't a problem. Taking an excerpt from the comic for illustrative purposes falls under fair use.
Reaction Image RepositoryAm I to guess that it also depends on how small a fraction the excerpt is? If so that is a point in favour of this image as it uses two panels from a 10-panel comic.
In any case, what about the larger version of the same two panels?

Exactly. It would not be fair use to clip a copywrite notice off the full work. In this case 'the work' is the strip. One or two panels is an excerpt and there is nothing unethical about clipping the copywrite notice off.
You will observe that the copywrite notice is outside the frame of the image, indication it is about the strip, not that one image. If it were inside the frame, the specific image is being claimed and it would not be fair to use it.
