An expert witness concludes that Eileen suffers from Munchausen Syndrome by Proxy - she harms her children in order to get attention from herself. [=McCoy=] tries to appeal to Marty's instincts as a father, but he still denies that Eileen has done anything wrong. So [=McCoy=] decides that both parents should be charged with murder. Matters are further complicated by the fact that only Emily's death is on trial; [=McCoy=] isn't allowed to ask about the deaths of the other two children. The jury hangs, 9-3 in favor of conviction.

Marty Willick reports that his 3-month-old daughter Emily was snatched in a park. It soon becomes clear that his story isn't true. Eventually Marty confesses that he disposed of Emily's body, and the police recover it. Marty says that Emily was a crib death, and he wanted to protect his wife Eileen. But the detectives discover that Emily is the Willicks' third child to die in a "crib death." Their doctor attributed the first two deaths to genetic causes, but then the Willicks had a foster child taken away because of suspicions they'd tried to smother him. Eileen clearly has psychological problems and says that no one "understands". The Willicks are arrested.

[=McCoy=] declares that he'll only offer a plea deal if Eileen agrees to be sterilized, but the judge says no and grants a motion for [=McCoy=] to be removed from the case. He notices that Eileen recently started seeing a new doctor, who happens to be an obstetrician. Sure enough, Eileen is expecting yet another baby. Marty, who didn't know about her pregnancy, is shocked. Confronted with the reality that she won't stop killing, he confesses that he walked in on her smothering Emily. Eileen goes to jail and Schiff says that, by the time she gets out, the baby should be grown up and able to defend themselves.
