* DropDeadGorgeous: Constance is shown nude when Bitsey views the footage of her death. Also invoked in-universe as part of Nico's crime scene tours: Nico sells videotapes of herself re-enacting Constance's death and offers two different versions, the more expensive video being the one "with tits."

* BrokenAesop: The film is very clearly against the death penalty, by trying to show that an innocent person can get executed. The problem is that [[spoiler:rather than showing someone who's a victim of circumstances or a frame-up, which would perfectly demonstrate its point, it shows the victim trying to "prove" that innocent people can get executed by framing ''himself'' for a crime he didn't commit, in the hopes that he will be exonerated and the death penalty will be abolished [[ThanatosGambit after he's wrongly executed]]. Interestingly, the film ''does'' seem to be at least somewhat aware of how clueless this looks; the whole plot comes about partly because the governor in the film made a statement that he would call a moratorium on further capital punishment if anyone were ever wrongfully executed, but once this actually does happen, [[AllForNothing he refuses to do so]] because the state can't be held accountable for someone abusing the system [[SuicideByCop to deliberately kill themselves]]]].

* DeathSeeker: David is actually looking forward to being executed. [[spoiler:It also backfires against him: his grand political statement against the death penalty is ruined by the Governor pointing out that it was an elaborate suicide and thus [[MovingTheGoalposts not falling under the purview of his moratorium proposal]].]]

* FanDisservice: Laura Linney has an extended nude scene. [[spoiler: In which, as part of the whole plan to make her suicide look like murder, she undresses completely, ties a bag over her head, cuffs her wrists behind her back and duly suffocates to death. Her character's suffering from cancer at the time too, so her body is covered with unsightly red blotches.]]

* SenselessSacrifice: [[spoiler:To eliminate the death penalty, Gale elaborately set himself up to be blamed for Constance's death, with his innocence being revealed after he's dead. Once the scheme is revealed, the governor refuses to call a moratorium about the death penalty due to Gale manipulating and abusing the system, meaning that he allowed himself to be executed for nothing]].
