Yes, he did take her Zanpakuto, but it was never specified that it was \'\'\'Suzumushi\'\'\', just one that looked similar to it. Him being able to use the Shikai and Bankai of another Shinigami\'s Zanpakuto goes against everything established about the concept in the series, and Kubo has never once gone THAT far off-base.
