To make a name there are like 10 different ways to make it, some of them are obscure or not appropriate so they made a law to only limit the characters to non-obscure and appropriate characters. It was a law made after WW 2, *googling the exact numbers* 843 "name kanji" and 2,136 commonly used characters are allowed to be used in a name.
There was a lawsuit won a few years ago that had a judge say they cant do things like that as common characters are shifting by region and such so they have since started to increase the allowed characters, things not appropriate like using the kanji for "Akuma" aka devil are still banned.

Yeah, I don't know the rationale behind what kanji are and aren't allowed, only that the rule exists.

It was an attempt to simplify Japanese names a bit so that names are actually readable by people, limiting it to just 3000! total characters to make up a name. It went with school system reforms and teaching modern kanji in an attempt to centralize the Japanese language.
It also banned rude and inappropriate Alternate Character Reading, So you cant name a person 'Shithead' but its read as 'Hitomi' or something to that effect.

There are only certain characters that are legally allowed to be used in given names. Try to use something outside that list the government will refuse to register the name and tell you to go back and change it.
And where's the harm in that character? I mean, not that I know much about the language, but is it a matter of romanization?
