I don't really know much about Aquaman, but seeing as he's one of the JLA's founding members, his chances seem decent.
And he's only been a joke in one version. He's quite an Ensemble Dark Horse right now.

Green Arrow will probably be in. So will Black Canary. A Green Lantern (Kyle Rayner or John Stewart would be my first choice) is a given.
For villains...I'm not sure. Captain Cold, Brainiac, maybe Sinestro.
I will be shocked as hell if they use any Green Lantern but Hal Jordan. Which is a pity, he's the blandest, poorest concept GL they have. . . but he's the Holy Silver Age Standard, and therefore he is supreme.
( at least until Geoff Johns finally either retires or somehow gets himself fired. . . )

I really hope they put Captain Marvel in it. I've never actually read any of his comics, but I have this inexplicable fondness for the character. It made me smile to see he was in MK vs DC, even though I never played it.

I don't know many popular characters debuted after 1990 anyway, but Batman has a couple. Bane and Hush are actually two characters who would fit the tone of the game pretty well.
And Time Drake debuted as Robin in 1989. That puts all the Robins that most people are even aware of before your arbitrary cutoff date.
Ted Kord was a character DC got from Charleston Comics. He's much older than the '90s. In fact, Nite Owl, from Watchmen is an expy of him, since DC didn't want Alan Moore making all their shiny new old characters unusable.
I meant Jaime Reyes when I said Blue Beetle. If they were to use a version it would probably be him since he's actually appeared on TV within the last five years.
