Keep in mind that not everyone who downloads it will buy it. In fact, since it's been available on the internet for so long some people who would have bought it now won't because they've already played it. Only a certain fraction of people who play the game are going to be devoted and loyal fans, and only devoted and loyal fans will spend money to play something they've already played.
And even of that, how many would pay full retail price (you don't honestly think they'd bring it over just to give it a budget price, do you?) for a game that would be two generations out of date by the time it releases?
Considering how I actually own a physical copy of MOTHER 3, and the fact that any theoretical stateside distribution at this point would be digital (because everyone knows that those $10 price points on the VC are total ripoffs), I can heartily say yes, yes I would.
Oh and judging by the fact that Earthbound and MOTHER 3 currently occupy spots in the Top 3 for most demanded VC releases, I'm fairly confident that I wouldn't be alone.

Unless Mother 3 is still in production, Nintendo won't even loose any money. They don't get anything from secondhand sales.
If you really don't feel confortable loading this, than I'm not going to presure you. But the legal consequences are virtually non-existant and, considering Nintendo actually recomended the fan translation, I don't see any moral issues you can have.

Wait...the original game has a Bestiary/Practice tool. I imported the game, and it's there and perfectly accessible at all times.
