On the finale a troper states that Ozai is a pushover without firebending. Actually taking away his bending only makes him as dangerous as a real life genocidal dictator with an army of devoted followers who can firebend and earthbend. And they could successfully spring him.
Ozai didn't have an army of Earthbenders. Azula had the Dai Li, but they're not the most loyal bunch in general, and she banished them anyway.
You're right, and it wouldn't be likely they'd transfer their loyalty to him either since it's earthbenders he tries to genocide. Too bad for my jailbreak theory, since they would've been the most competent.
Also, I bet his legion of firebenders are weary of the war and not so willing to stand up to the Avatar.
