What makes you think those are mutually exclusive?

Nothing. I just wanted to know if it qualified as a Batman Gambit.

As written, just seems to be Evil Plan. Might be Batman Gambit as well but as written it seems fairly straightforward.

Batman Gambit is often confused. It means a plan that relies on a specific prediction about the behavior of the victims/dupes, based on knowledge of their psychology/patterns. It fails if they don't behave as predicted.

Evil Plan is one of those supertropes that's almost a qualifier for omnipresence. The example given above is little more than a summary of the plot.

A lot of Evil Plan examples are former examples of Xanatos Gambit that did misuse it and were changed to Evil Plan as the better trope.
