What we have now results either in Karma Houdini (just a few years in prison for a freaking murder in some cases) or Disproportionate Retribution (jail time for a theft?! It should be fine instead)
If we disagree, that much, at least, we have in commonI've often believed that for crimes in which there is a direct victim (such as murder, rape, etc.), either the victim or, if the victim is unable to attend, the family of the victim should be allowed to decide the penalty.
Something about putting the criminal at the mercy of those he wronged seems harsh yet strangely appropriate.

This "faculty lot" you speak of sounds like a place of great power...^Well, I guess it's not that harsh now, but I do not consider incarceration to be a just punishment for mere property crime, period. Thief did not deprive anyone of freedom, did not cross several years out of anyone's life, after all. He merely taken a thing that belongs to another, a material possession, so a material possession of his own should be taken. Perhaps of greater value than that was stolen, in order to discourage theft as a means of getting a loan, so to speak, but still - nothing more than material possession.

Theft is a difficult one to adequately punish, I think, because the offense doesn't cause direct physical harm to anyone, but is still a victimizing crime, and it's harder to give an eye for an eye when the perpetrator doesn't have an eye to give.
Small-scale "Hey, I jacked a pocketknife from a convenience store," theft is simple enough, but when you get into the larger crimes, it gets a bit more complicated. Typically, when you commit theft, it's because someone else has something that you don't. If it's something of value, you're stealing it because it's worth money that you don't have. I think that's where the imbalance comes from: you can't just take double the money back when there's no money to take.
Which doesn't mean I disagree with An Eye For An Eye, not by a long shot. I mentioned in an earlier post my view on it. Theft is just...complicated.

The entire purpose of punishing a crime is to rehabilitate and reintegrate a criminal into society. Not everyone who commits a heinous crime is so far gone that they can't be helped, and to torture them to satisfy a thirst for vengeance just seems disgusting.
If someone is so for gone that they can't be helped, just kill quick and painlessly and get it over with. Don't toy with their lives.

There are three purposes I can think of for a punishment:
- 1. To rehabilitate the criminal.
- 2. To satisfy the pain of the victim.
- 3. To prevent the criminal from victimizing any more.
To me, #3 takes priority above all else. #2 is next priority, and then #1, if applicable.
When a person commits a crime such as murder, he forfeits the right for his own wellbeing to be considered in the matter. Theft is complicated, as I mentioned above, but if you knowingly and deliberately kill someone, helping you live a long, happy life becomes dead last on my list.

Some people aren't worth rehabilitating, and I shudder to think that a serial rapist or sadistic thug could ever be freed even if they were truly "rehabilitated". They don't seem to deserve a second chance or even a life.
